The Elkhorn Homeowners Association, Inc. (Elkhorn) is a domestic non-profit organization registered with the Montana Secretary of State. Elkhorn is a residential development of approximately 550 acres divided among fifty-nine lots, located roughly four miles northwest of Whitefish on the north side of State Highway 93 between Spencer Lake and Beaver Lake. The development is effectively surrounded by US Forest Service (Flathead National Forest) and Montana State Trust Lands. There are more than thirty-two residences within the development, split between full-time and part-time members. The fifty-nine lots within the development are subject to written covenants, conditions, and restrictions (Elkhorn HOA Third Restated Declaration of Covenants, Conditions and Restrictions — 060418). All property owners are members of the Elkhorn Homeowners Association and governed by an elected Board of Directors.
